Terms and Conditions of Sale

These Terms and Conditions ("Terms") govern your use of www.gearmaxpro.com (the "Site") and any purchase you make from Trailer Gear Max, LLC ("GearMax Pro", "we", "us"), 395 US-180, Seminole, TX 79360, USA. By using the Site or placing an order, you agree to these Terms.
1. Products and information
We try to describe our products (winches, hydraulic cylinders, trailer parts and accessories) accurately, including ratings such as line pull, capacity, pressure and voltage. Always follow the manufacturer's instructions and never exceed the rated capacity of any product. Images are for reference and may differ slightly from the product delivered.
2. Prices and payment
Prices are shown in US dollars (USD) and do not include shipping or applicable sales tax, which are calculated at checkout. We may correct pricing errors and may cancel orders placed at an incorrect price, with a full refund. Payments are processed securely by our payment provider, Stripe; we do not store your full card number.
3. Orders and availability
Your order is an offer to buy. We accept it when we confirm or ship your order. We only accept orders for products that are in stock at our U.S. warehouse. We may refuse or cancel an order (for example, if a product becomes unavailable or we suspect fraud) and will refund any amount charged.
4. Shipping
Orders ship from our warehouse in Seminole, Texas. Orders paid before 12:00 pm Central Time on a business day ship the next business day, and most orders arrive within 3–4 business days after shipment. We ship with UPS and FedEx. See our Shipping Policy for details.
5. Returns and refunds
You may return a product within 5 days of receiving it, under the conditions described in our Returns & Refunds Policy.
6. Warranty
All GearMax Pro products are covered by a one (1) year limited warranty against manufacturing defects, starting on the date of delivery. The warranty does not cover damage caused by misuse, improper installation, exceeding the rated capacity, normal wear and tear, or unauthorized modifications or repairs. To make a warranty claim, contact us through our contact form with your order number, a description of the problem and photos. Except for this warranty and to the extent permitted by law, products are provided "as is".
7. Limitation of liability
To the maximum extent permitted by law, GearMax Pro is not liable for indirect, incidental or consequential damages arising from the use or misuse of our products or the Site. Our total liability for any claim related to a product is limited to the amount you paid for that product.
8. Dealers, fleets and wholesale
Distributor, OEM, fleet and wholesale purchases may be subject to separate written terms.
9. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules.
10. Changes
We may update these Terms from time to time. The version posted on the Site applies to orders placed after the update.
